Robert Hocker’s practice has been limited to civil litigation and trials for over 17 years.
Robert was born, raised and educated is northern California. He came to San Diego in 1992 to serve a judicial clerkship. After two years with the Court, Robert joined a prominent local San Diego law firm, McInnis, Fitzgerald, Rees & Sharkey. After a string of jury trial successes, Robert was soon handling multimillion dollar litigation. In 1999, the McGinnis firm was purchased by one of San Diego’s oldest and most respected firms, Higgs, Fletcher & Mack, where Robert became a partner.
In 2003, Robert started his own firm and, in 2007 was joined by Mike Nalu, a good friend and alum of Higgs, Fletcher & Mack. Robert has successfully tried to verdict a wide variety of matters and is often asked to come into cases for the sole purpose of handling the trial. The following is a list, in alphabetical order, of the areas in which Robert has significant experience:
Business Litigation: Robert has handled and tried a variety of business disputes including cases involving claims for breech of contract, tortuous interference with contract, unfair competition, fraud, partnership disputes, and breach of fiduciary duty.
Construction Litigation: Robert has represented owners/developers, both private and public, in litigation through trial and binding arbitration. These cases have included multimillion dollar construction delay, breech of contract and change order cases.
Employment Litigation: Robert has vast experience in employment litigation through trial on both the defense and plaintiff’s side, including claims for wrongful termination, employment discrimination /retaliation, wage & hour, and unfair competition/trade secret.
Legal Malpractice: Earlier in his career, Robert defended attorneys, now he limits his practice to representing plaintiffs in legal malpractice matters. Personal Injury: Robert has handled a wide rarity of personal injury cases including a number of civil jury trials to verdict.
Public Entity: Since 1994, Robert has handled hundreds of claims against public entities and is well versed in this area of the law. Robert has litigated through trial a wide variety of public entity cases including employment cases, personal injury cases, special education cases, construction matters and cases involving violation of civil rights.
Real Estate Litigation: Robert has handled cases as small as residential non-disclosure and breach contract matters to trials of multi-million dollar commercial real estate transactions.
